Previous EO by Obama designated elections as "critical infrastructure" and allocated DHS authority. New announcement dissolving the Commission on Election Integrity hands the matter over to DHS who has authority to investigate it and make recommendations, effectively bypassing courts and typical challenges. It is a National Security matter and will be treated as such.

In reviews conducted by administrative agencies, Section 7(c) of Republic Act No. 6713, otherwise known as the "Code of Conduct and Ethical Standards for Public Officers," prohibits any public official or employee from using or divulging
confidential or classified information officially known to them by reason of their office and not made available to the public, either to further private interest or give undue advantage to anyone, or to prejudice the public interest.
Republic Act 3019, the Anti-Graft and Corrupt Practices Act, further declares as unlawful the act of a public official or employee in divulging valuable information of a confidential character acquired by his office, or by him on account of
his official position, to unauthorized persons in advance of its authorized release date. |
